Last week, the Supreme Court heard arguments in Consumers vs FCC, a case centered on the constitutionality of the funding mechanism of the universal service fund. Both liberal and conservative Justices expressed skepticism about the arguments challenging USF’s constitutionality advanced by Consumers’ Research, the conservative group that brought the case. ESEA Flexibility Discussions
|
A recent article in Education Week examined how states could encounter much more flexibility at ED if they submit waivers regarding funding, assessments and accountability. The article discusses waiver ideas that states may approach ED with such as matrix sampling for assessments as well as more nefarious waiver requests regarding making IDEA funding “portable” to students in private schools/homeschools. In addition, we are flagging this just-released handy document that outlines what states need a waiver to do and what requirements can be waived.

As you know, there have been numerous education-related executive orders, administrative actions, and legal developments. All of EducationCounsel’s resources are now available in one place. OCR Begins K-12 Title IX Enforcement
|
In its initial Title IX enforcement actions (and implementation of the President’s executive orders about transgender women and athletics), USED’s Office of Civil Rights (OCR) focused on investigating universities, including high-profile actions against the Maine higher education system and the University of Pennsylvania. Last week, however, OCR broadened its actions to include K-12 systems (in Maine) and also investigate K-12 policies (in Illinois) providing students access to locker rooms and bathrooms that align with their gender identity.

Chaos and Confusion as the Statistics Arm of the Education Department is Reduced to a Skeletal Staff of 3

The Hechinger Report analyzes the potential impacts of the Institute of the Education Sciences’ recent staff reduction. Overall, IES was RIF’d from 175 to 20 employees, with the National Center for Education Statistics (NCES), which among other things administers NAPE, reduced to just three staffers.

Prominent conservative education commentator Frederick Hess of AEI examines the recent staff reductions at USED, raising concerns not about the overall goal of reducing USED, but about the lack of transparency and unclear rationales for the particular cuts being made.

ESAs Engage State Leaders Across the Nation

Last week was a busy and impactful one for state advocacy efforts across the country. From Monterey COE in California engaging with legislators, to Nebraska’s Education Service Unit Coordinating Council meeting with NE Governor Jim Pillen, to Pennsylvania’s Intermediate Units hosting their Day on the Hill—education leaders were actively championing the needs of students and schools.
