As Q1 of 2025 legislative sessions ends, education remains a top priority, with 3,396 bills introduced and 136 enacted. Key focus areas include educators, curriculum, school choice, technology, and student groups. States are passing laws to address teacher shortages, recruitment, and retention, while debates over parental rights and curriculum mandates continue. Advocacy remains crucial to shaping policies that support educators and students.

Congress introduces IDEA Full Funding Legislation
|
AESA and AASA are proud to co-chair the IDEA full funding coalition. Both the House and Senate last week introduced stand alone legislation that would put Congress on a path to honor its funding commitment to IDEA. The IDEA Full Funding Act is not likely to get any major airtime, but remains a top legislative priority for AESA and becomes a point of leverage in appropriations conversations to push back against cuts. AESA Advocacy Partner Breaks Down Reconciliation vs Appropriations
|
This month's edition of AASA's The Advocate is about the budget reconciliation process in Congress. This legislative process, known as budget reconciliation, is the same one that was used to pass the American Rescue Plan, the Inflation Reduction Act, and the 2017 Tax Cuts and Jobs Act.
We understand there is a lot of confusion around the differences between the budget reconciliation process underway in Washington and then traditional appropriations process. AASA created this graphic to help you and your members understand the differences.

USED Reverses Policy of Allowing Late Liquidation of ESSER Funds
On Friday, March 28, Secretary McMahon sent letters to state chiefs informing them that USED was rescinding all approvals of late liquidation of COVID-era relief funding (across all of the different grants). Among other things, the letter asserted that any reliance by states or districts on USED’s approval was “unreasonable.” That said, the letter also left open the possibility of getting extensions re-approved via case-by-case appeals. It is not clear how those will be processed in a timely way on the heels of the 50% RIF at the agency. (EdWeek’s comprehensive coverage of this controversial development is available here. USED Issues Dear Colleague Letter about FERPA and Students’ Gender Identity
On Friday, March 28, USED’s Student Privacy Policy Office (SPPO) issued a Dear Colleague letter about state and district obligations under FERPA and the Protection of Pupil Rights Amendment (PPRA). The letter was issued alongside two enforcement actions the SPPO announced—one in California and one in Maine—regarding state/local policies governing when and how information about students’ gender identity (e.g., any changes to names or pronouns) is stored and shared (or not) with parents (upon request or in affirmative ways).
USED Sends Letter to States on Leveraging Flexibilities in Title I Funds to Support Education Choice
On Monday, March 31, the Office of Elementary and Secondary Education sent a letter to all chief state school officers informing them of existing flexibility in federal formula funds under the Elementary and Secondary Education Act of 1965 (ESEA) to support education choice initiatives. Providing guidance to states on this flexibility is one of the Department’s first actions in implementing President Trump’s Executive Order Expanding Educational Freedom and Opportunity for Families.
